What percentage of my check can be garnished to pay for child support arrears? 

Two different percentage amounts may be garnished from your check to pay child support arrears depending on your situation.

Obligation for spouse and/or child separate from current order:

If you are currently supporting a spouse or child who is not the subject of this particular child-support order, 50% of your check may be garnished to pay for your child support arrears.

Obligation for spouse and/or child of the current order only:

If you do not have a spouse or a child that you are supporting that is separate from the current order, 60% of your check may be garnished to pay for your child support arrears.

If you are behind in your child-support payments for at least 12 weeks, an additional 5% may be garnished from your check to pay for arrears. Thus, you can expect to have between 55% to 65% of your check being garnished for child support arrears depending on your particular situation.

Therefore, in order to avoid possibly having such a large amount of your check being garnished to pay for your child support obligations, be certain to keep current with your child-support payments.
