What Is The Process Of Settling Time-Share And Visitation Rights For Children During A Divorce If The Parents Can’t Reach An Agreement?

 

The issue that I have been presented with numerous times during a divorce with couples who have children, is that they are not able to come together to reach an agreement as to the timeshare, the visitation schedules of their children.

What I explain to these couples is that when we go through a divorce, there is a mandatory family mediation that both parents must attend with an unbiased third-party mediator who is going to help them try to reach an agreement as to the parenting plan, timeshare, holidays, visitations, how they want to split up their week and what kind of custody they wish to agree upon.

After going to this mediation, if unfortunately, it results in no agreement, then the only other option now is for us to attend and appear before the judge in a trial. Trials are costly, they demand a lot of time, a lot of expense, and a lot of emotional turmoil for the parents as well as the children. I always counsel my clients, to always try to come to an agreement as to the custody of their children in the division of time and the holidays and try to work it out amongst themselves. Because if they don’t, then you will leave your future to a judge who might not necessarily know your family as well as you do.

This judge is going to look at what is in the best interest of the children and then make that decision as to how and when the parents will have time with their own children.

I strongly believe that the parents should try every method available to come to an agreement between themselves. But if at the end of the day, they are not able to, then it will be up to a judge in a trial to make the decision as to how those parents are going to share custody and visitation of their children.
