What Is a Non-Contact Order?

What Is a Non-Contact Order?

This term usually refers to a criminal court case but it is the same thing as a Temporary Restraining Order in family court. It is a 45 day long restraining order that the courts issue on an emergency basis without holding a hearing.

A Temporary restraining order is generally done whenever a party is fearful of harm from another party. It is meant to guard against domestic violence, harassment, stalking workplace harassment, sexual assault, or child abuse. While the TPO is in effect the victims may apply for a one-year extension period if they still feel that they are in threat of imminent harm.

If the judge issues this TPO or the restraining order the court will arrange for the adverse party to be served with a copy of the order. The order usually lasts about 45 days, unless you apply for it to be extended.

The initial order does not require a hearing but the extension of that order does require you to go before the court and have a hearing to be sure and explain to the court that you are in fact still feeling the threat of an imminent harm.

No-contact or a temporary restraining order are the same and the terms are used interchangeably depending if it is for a criminal or a civil case.
