My Ex-husband And I Don’t Agree On Medical Decisions Regarding Our Son.

Today’s question comes to us from Jessica, and she is concerned that she and her ex-husband cannot agree to medical decisions regarding their son.

So, Jessica’s situation is very common, she had a divorce her husband two years ago. They were both awarded joint legal and joint physical custody from the court. They are not unfortunately very amicable in their relations, and they struggle to co-parent because they don’t agree with a lot of decisions that have to do with their son.

Their son has a medical condition that requires constant medical attention, and they need to make decisions as to doctors, and medical providers, they can never agree on this.  If the husband unilaterally decides to make decisions without consulting her, she’s very frustrated at this.

What I explained to Jessica is that the courts, when the courts order joint legal custody, this gives the parents, both parents, the right to make decisions as to the child’s education, medical, safety, extra-curricular activities, religion, anything, any life decisions that concern their child.

Unfortunately, because they don’t have a good relationship, it’s very difficult for them to come to an agreement as to these decisions, and it becomes problematic. In situations like that, what you need to know is that one parent does not have the right to make a unilateral decision without consulting the other if the parents have been awarded joined legal custody.

In this situation, unfortunately, you must seek help from the court. You must file a motion with the court, addressing these issues before the court, and in very, very dire circumstances, very strict circumstances, very difficult circumstances, the courts may at times award sole legal custody to one of the parents to avoid any further issues that might arise from making these difficult decisions, especially when it comes to a medical decision that is an ongoing concern for a child with medical issues.
